Michigan joins the bold

Rep. Opsommer offered the following concurrent resolution:

use Concurrent Resolution No. 4.
A concurrent resolution to affirm Michigan’s sovereignty under the Tenth Amendment to the Constitution of the United States and to urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.
Whereas, The Tenth Amendment to the Constitution of the United States reads as follows: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; and
Whereas, The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and
Whereas, The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and
Whereas, Today, in 2009, the states are demonstrably treated as agents of the federal government; and
Whereas, Many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

Whereas, The United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and
Whereas, A number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States; now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That we hereby affirm Michigan’s sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. We also urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States; and be it further
Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
The concurrent resolution was referred to the Committee on Government Operations.

Wow we are getting bold or what?? We seem to be joining 17 other states in telling the Feds no more orders!

Hey Kingfisher,

Has there been any other movement on this? If we loose state sovereignty we are no longer the United States of America. I didn't put my ass on the line in Iraq to come home to my country being lost to socialism.

BTW: You and I know each other. I used to run the MI Angler forum and worked with you in the now defunct Michigan Musky Hunters Club. After 9/11 I pretty much stopped fishing and went to war. I am only now dusting off the old musky sticks and getting back into fishing.

BTW- The Michigan Musky Hunters Club, is not defunct, it is ALIVE and well, although it is a small club of about 25 members, it still exsists with outings and meetings, if you would like more club information you can contact.

I don't know anything about the resolution, but here's a thought....

many states have the problem of "unfunded mandates". In other words, the feds are telling a state what the state must do, but the feds don't provide the funding to accomplish the mandate. States suffering big deficits are struggling with compliance, but they struggle on because lack of compliance creates risk of losing existing fed funding. A circle jerk to be sure but it happens all the time.

Maybe the resolution was directed toward this issue?

Well, it is to resist federal Mandates. We are broke and can not afford to spend a dime on Obamas social programs. Even our Liberal Governor knows this. I dont think she signed the bill though. I am not sure if this was passed or not. 37 states have now passed the 10th with Texas being the loudest. Montana in fact just passed a new law that goes into effect in October repealing all federal Gun control laws regarding any firearm manufactured in the state of Montana and kept in the State of Montana.

They just protected thier rights to own Semiautomatic rifles with large magazines. all the way up to antiaircraft diameter bores like the 20mm cannon. 50 cal semiauto rifles etc. The bore restriction 1.5 inches. ha ha ha . Thewy are not allowing Machineguns though. This law is on the books. I am watching that one with real interest. What will the feds do? What can they do? as long as Montana resident do not cross state lines with those weapons The feds cant trump the law.
